Personal data means any data that may be used to identify an individual, including but not limited to the following:

3.1.1 Information about your personal identity inter alia as name, age, sex, income, education, occupation, etc.

3.1.2 Your contact details such as your address, postal code, telephone or mobile number and facsimile.

3.1.3 User ID information such as your username, email address and other security-related information used by you in relation to access and use our website and content, User ID of social networks etc. However, the password of your account with the website shall automatically get saved in our server when you create an account or register with the website which shall not be accessed by the Company unless desired under any legal obligation.

3.2.1 Account Information: Information associated with an account that licenses MyKia, which may include administrator name, contact information, email ID.

3.2.2 Profile and Participant Information: Information associated with the MyKia profile of a user who uses MyKia Products under a licensed account or that is provided by an unlicensed participant joining a meeting, using MyKia and its functionalities which may include name, display name, picture, email address, phone number, job information, stated locale, user ID, or other information provided by the user or their account owner.

3.2.3 Contacts and Calendar Integrations: Contact information added by accounts or their users to create contact lists on MyKia, which may include contact information a user integrates from a third-party app. Users can also integrate their calendars from other services with their MyKia profile or account. locale, user ID, or other information provided by the user or their account owner.

3.2.4 Settings: Information associated with the preferences and settings on the account or user profile, which may include audio and video settings, recording file location, screen sharing settings, and other settings and configuration information.

3.2.5 Registration Information: Information associated with the preferences and settings on the account or user profile, which may include audio and video settings, recording file location, screen sharing settings, and other settings and configuration information.

3.2.6 Device Information: Information about the computers, phones, and other devices people use when interacting with MyKia platforms Products, which may include information about the speakers, microphone, camera, OS version, hard disk ID, PC name, MAC address, IP address (which may be used to infer general location at a city or country level), device attributes (like operating system version and battery level), Wi-Fi information, and other device information (like Bluetooth signals).

3.2.7 Meeting, Webinar, and Messaging Content and Context: Content generated in meetings, webinars, or messages that are hosted on MyKia, which may include audio, video, in-meeting messages, chat messaging content, transcriptions, written feedback, responses to polls and Q&A, and files, as well as related context, such as invitation details, meeting or chat name, or meeting agenda. Content may contain your voice and image, depending on the account owner’s settings, what you choose to share, your settings, and what you do on MyKia.

3.2.8 Product and Website Usage: Information about how people and their devices interact with MyKia Products, such as: when participants join and leave a meeting; whether participants sent messages and who they message with; performance data; mouse movements, clicks, keystrokes or actions (such as mute/unmute or video on/off), and other user inputs that help MyKia to understand feature usage, improve product design, and suggest features; which third-party apps users add to a meeting or other Product and what information and actions the app is authorized to access and perform; features used (such as sales, aftersales, rewards, other common features, screen sharing, emojis, or filters); and other usage information and metrics. This also includes information about when and how people visit and interact with Kia India Website including what pages they accessed, their interaction with the website features, and whether or not they signed up for a MyKia Product.

3.2.9 Communications with MyKia: Information about your communications with MyKia, including relating to support questions, your account, and other inquiries.
Information from Partners: MyKia obtains information about account owners and their users from Kia dealerships.

3.3 Kia Connect Account

3.3.1 Personally Identifiable information:
Personal data means any data that may be used to identify an individual, including but not limited to the following:

3.4.1 Contact and Demographic Information
We may collect information about your contact details (including your name, address, email address, phone, mobile numbers and social media handles) and demographic information about your age, gender and occupation.

3.4.2 Vehicle Information
We may collect information about your Kia India vehicle, including its number plate and vehicle identification number (VIN).

3.4.3 Dealings with Kia India
We may also collect answers you provide to questions we ask and other information relating to your dealings with Kia India or its dealers.

3.4.4 Kia Connect Usage
If you register/use Kia Connect, we may also collect information (some of which may be personal information about you), including:
(i) the number of trips and distances that you have driven.
(ii) the location of your vehicle, including historical locations.
(iii) vehicle diagnostic information, such as tyre pressure, amount of fuel in the tank and engine information.
(iv) vehicle driving information, such as speed, braking and acceleration information; and mobile phone information such as number, model, operating system and personal location data where you have activated location services on your mobile device.

3.4.5 Roadside Assistance
If you request or receive roadside assistance services, we may collect information about where (e.g., location) and when (viz., date, time) you requested roadside assistance services and the assistance service that is required.

3.4.6 Kia Connect Visits and Cookies
Upon your visit to/usage of Kia Connect, we may record your server IP address, domain name, the date and time of your visit and the pages viewed, etc. This information may be collected using cookies. User preferences are stored in cookies, which track user trends and patterns of use, and allow Kia Connect to interact more efficiently with you.

3.4.7 Other Legally Permitted Information
In addition to the types of information identified above, Kia India may collect personal information as otherwise permitted or required by applicable law.

3.5 Information we collect from other sources

We may access information about you from third-party sources and platforms (such as social networking websites, databases, online marketing firms, ad targeting firms), and from our authorized dealers who may collect your information during sales or service interactions:

3.5.1 Our authorized dealers may independently collect personal data from customers for specified purposes related to sales, services, and customer engagement. The types of personal data that may be collected include the customer’s name, mobile number, academic background, income range, occupation, and professional details. Such information is collected to process vehicle purchase inquiries, provide relevant information or assistance regarding potential purchases, facilitate financing and insurance applications where applicable, and to deliver appropriate customer support, respond to queries, and ensure an effective customer experience.

3.5.2 If you access third-party social networking services (such as Facebook, X etc.) or visit any of our social media official pages, we may collect, personal contact information and/or any personal data that is part of your profile on a third party social network (e.g. Facebook, X, etc.) and that you allow that third party social network to share with us (e.g. name, email address, gender, birthday, city, profile picture, user ID, friend list). You can learn more about the data that we may obtain about you by visiting the privacy policies on the website of the relevant third-party social network.

We may contact you in your vehicle or email, or by telephone at the contact number provided by you, and, in some circumstances, by prerecorded message, even if doing so may result in additional telecommunications fees or charges to you, to discuss your account, offer unsolicited promotions, or to deliver services.
To provide you and our authorized Kia India dealers with necessary support.
To attend to or assist in the servicing or repair of your Kia India vehicle, including the provision of roadside assistance services.
To provide you with notifications and information about your Kia India Vehicle.
To inform you of a field service action affecting your Kia India Vehicle.
To send you service reminders.
For product development, market research, and other marketing and promotional activities.
To carry out our legal compliance obligations, such as to conduct a product safety recall where necessary.
To contact you directly or through our service providers and research agencies, to obtain your feedback and find out your level of satisfaction with our products, services and our authorized Kia India dealers.
Kia India records the basic information about your visits to Kia Connect usage, for systems administration, statistical and troubleshooting purposes. We use your IP address to help diagnose problem with our server and to administer Kia Connect.

4.7 To provide the service and for quality assurance and training purposes
The authorised third party service providers may monitor and record conversations between their respective service centers and you and your vehicle’s occupants or others. You, on behalf of yourself, all occupants of your vehicle, and anyone engaged in a conversation with an authorised third party service providers about your vehicle or your Kia Connect account, consent to monitoring, recording and sharing of call recordings of all conversations between the authorised third party service providers and you or others and you release Kia India and its Service Providers from and against any and all claims, liabilities, losses etc. arising out of such monitoring, recording or sharing/disclosure of conversations.

4.8 MyKia App

4.8.1 Provide MyKia Products and Services:
To provide Products, features, and services to account owners, their users, and those they invite to join meetings and webinars hosted on their accounts, including to customize Product features and recommendations for accounts or their users. MyKia also uses personal data, including contact information, to route invitations and messages to recipients when people send invitations and messages using MyKia Products. This may also include using personal data for customer support, which may include accessing audio, video, files, and messages, at the direction of the account owner or their users. We also use personal data to manage our relationship and contracts with account owners, including billing, compliance with contractual obligations, and related administration.

4.8.2 Product Research and Development:
To develop, test, and improve MyKia Products, including, for example, content-related features (such as background filters), and to troubleshoot products and features.

4.8.3 Authentication, Integrity, Security, and Safety:
To authenticate accounts and activity, detect, investigate, and prevent malicious conduct or unsafe experiences, address security threats, protect public safety, and secure MyKia Products.

4.8.4 Communicate with You:
We use personal data (including contact information) to communicate with you about our Products, features, and services, including product updates, your account, and changes to our policies and terms. We also use your information to respond to you when you contact us.

4.8.5 Legal Reasons:
To comply with applicable law or respond to valid legal process, including from law enforcement or government agencies, to investigate or participate in civil discovery, litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our Terms of Service or policies.

MyKia uses advanced tools to automatically scan content such as virtual backgrounds, profile images, and files uploaded or exchanged through chat, for the purpose of detecting and preventing violations of our terms or policies and illegal or other harmful activity, and its employees may investigate such content where required for legal, safety, or security reasons.

4.9 Enforcement
We may use the data that we collect to prevent illegal activities, to enforce the privacy policy, and to otherwise protect our rights and the rights of our users.
In addition to the uses identified above, we may use the data that we collect for any other purposes disclosed to you at the time we collect your data.

5. How your Personal Data is processed and stored

We have networks, databases, servers, systems, support, and help desks located throughout our offices around the world and take steps to ensure that the information we collect is processed according to this privacy policy and applicable law wherever the data is located. In some cases, we may need to disclose or transfer your personal data within our company or to third parties, if required, such as to provide you with services or product you have requested. We collaborate with third parties, such as cloud hosting services, suppliers, market research agencies, and technology support located around the world to serve the needs of our business, workforce, and customers. 6. Disclosure of Data to Others

6.1 Legal Requests and/or Compliance with Applicable Laws
We cooperate with law enforcement and regulatory inquiries, as well as other third parties to enforce laws, such as intellectual property rights, fraud, personal data protection rights and other rights, to help protect you and the community. Therefore, in response to a verified request by any statutory authority including but not limited to law enforcement agency or other government officials relating to a criminal investigation or alleged illegal activity, we may (and you authorize us to) disclose, as per the applicable laws, some of your personal data as are reasonably necessary to respond/comply with the statutory mandate including but not limited to court orders or other legal process. We may access, use, transfer or disclose your personal data to third parties such as government or law enforcement authorities or private parties, if it is legally and statutorily required to do so under any of the following conditions:

(i) To satisfy any applicable law, rule, regulation, governmental requests or legal process.
(ii) To protect and/or defend and/or enforce our privacy policy for online services or other policies applicable to any online services in case of potential violations.
(iii) To secure our systems.
(iv) To respond to claims that an advertisement, posting or other content violates the rights of a third party.
(v) To protect the rights, property or personal safety of the users and the public in general for any reason.

In case of any illegal, unethical or legally actionable activity, we may use IP address or other device identifiers, to identify users, and may do so in cooperation with third parties such as internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion. Such disclosures may be carried out without notice to you. However, we shall not sell, share or rent the users’ personal data to any third party or use any users’ e-mail id for sending any unsolicited mails.

6.2 Other Corporate Entities
We share much of our data, including data about you, with our parent, affiliates, subsidiaries, and joint ventures that are committed to serving your online requests and related services, throughout the world. To the extent that these entities have access to your personal data, they remain bound by the existing privacy policy. As we continue to develop our business, we might sell or buy stores, subsidiaries or business units. In such transactions, Users’ Information generally is one of the transferred business assets but shall remain subject to the terms and conditions contained in this privacy policy.

6.3 Internal Service Providers
We may employ third parties services to facilitate or outsource one or more aspects of the business, product and service operations that we provide to you on the website (e.g., search technology, discussion boards, bill collection, affiliate and rewards programs, co-branded credit cards, merchandise, leasing, financing, exchange your car, etc.) and therefore we may provide some of your personal information to these internal service providers. 7. Protection and Security Information collected

8. Retention of Personal Data

8.1 Unless specified otherwise in this privacy policy, we will retain your personal data for as long as reasonably required for legal or business purposes, or as permitted or required by applicable law. In some cases, even after cancellation of the user account, your personal data may be retained for the purpose of legal and regulatory compliances, resolving disputes, concluding activities related to account cancellation, enforcing our agreements, privacy policy or for any other reason which may be deemed necessary. However, the personal data of the user will get anonymized upon cancellation of user account except for the abovementioned purposes.

8.2 Notwithstanding anything stated above, all personal data will be deleted once it has fulfilled its business or legal purposes, unless its retention is considered necessary as per applicable law.

9. Your Duties and Rights pertaining to your Personal Data

9.1 You are responsible for maintaining the accuracy of the Personal Data submitted at the time of login and are encouraged to keep it up-to-date.

9.2 You have the right to access, correct and update your personal data. You can access your personal data at any point of time by contacting us and proving your identity. We will respond within one month of you raising the request.

9.3 You have a right for your personal data to be erased / deleted. You may raise a request for your personal data to be deleted by contacting us and we will respond within one month of you raising the request. We will update you when your data has been deleted. In case we are unable to comply with your request due to legal or business reasons, we will update you about the reason. Notwithstanding anything mentioned above, your data will get anonymized upon acceptance of your request for erasure / deletion.

9.4 You have a right to nominate another individual who can exercise your rights on your behalf in the event of your death or incapacity ensuring that your rights related to your personal data remain protected, even if you’re not able to exercise them yourself.
