Kia Open Access Competition 2025/2026
Terms and Conditions

The promoter of the Kia Open Access Competition 2025/2026 (Competition) is Kia Australia Pty Ltd (ABN 97 110 483 353) (Promoter), 67 Epping Rd, Macquarie Park NSW 2113.

 

 

1. Acceptance of Terms and Conditions  

1.1         By entering the Competition, you accept the following Terms and Conditions. Information on how to enter and the prizes form part of these Terms and Conditions.

 

2. Competition Period   

2.1         The Competition commences on Saturday, 1 November 2025 at 09:30 AEDT and concludes on Sunday30 November 2025 at 23:59 AEDT (Competition Period).

 

3. Eligibility to Enter 

3.1         Subject to this clause 3, to be eligible to enter the Competition, an individual must be:

a)             18 years of age or older;

b)             a retail customer of the Promoter; and

c)             a resident of any state or territory of Australia,

(Eligible Entrants).

3.2         The following persons are not eligible to enter the Competition:

a)             employees and directors, and their immediate families, of:

i)          the Promoter or the Promoter’s dealers;

ii)         any entities or persons involved in the conduct of the Competition, including prize suppliers; and

iii)        any related entities of the abovementioned entities; and

b)             fleet customers of the Promoter, being customers who purchase Kia vehicles under an ABN, ACN or other entity and utilise the Promoter’s fleet pricing.

3.3         “Immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

 

4. How to Enter

4.1         Subject to this clause 4, Eligible Entrants enter the Competition by:

a)             purchasing and paying for (in-full) any new or demonstrator Kia electric vehicle (EV) from an authorised Kia dealer during the Competition Period (Qualifying Transaction); and

b)             opting-in to receive the Promoter’s direct marketing and promotional material throughout the Competition Period, and until all winners have accepted their prizes.

4.2         For the avoidance of doubt:

a)             purchases of hybrid (HEV) and/or plug in electric (PHEV) Kia vehicles are excluded from the Competition and do not constitute a Qualifying Transaction; and

b)             Eligible Entrants may opt in to receive the Promoter’s direct marketing and promotional material at the time of completing a Qualifying Transaction. If Eligible Entrants do not have the opportunity to provide their consent at the time of completing a Qualifying Transaction, they may also do so via the Promoter’s website at https://www.kia.com/au/shopping-tools/subscribe.html.

4.3         Multiple entries into the Competition are not permitted.

4.4         For the purposes of clause 4.1a), “purchasing and paying for (in full)” means to make payment for the full amount of the vehicle via any of the following methods:

a)             cash payment;

b)             payment via bank transfer or bank cheque;

c)             signed financial documents provided from the Kia dealership where the Qualifying Transaction was made; and/or

d)             signed financial documents via an external financier which includes proof of remittance.

 

5. Prizes

5.1         The prize is a “VIP Experience at the 2026 Australian Open” in Melbourne, Victoria (Prize). Subject to clause 6.3 below, three (3) Prizes will be awarded.

5.2         Eligible Entrants can only win a maximum of one (1) Prize.  

5.3         Further details of the Prize and the total Prize pool are set out below.

 

Prize Description 

Maximum Total Prize Pool RRP in AUD (including GST)

5.4         The Prize is a “VIP Experience at the 2026 Australian Open” in Melbourne for the winner and one (1) guest valued at up to $6,500 (including GST), depending on the winner’s point of departure. 

5.5         Each Prize includes the following:

a)             Two (2) x two (2) session tickets to the 2026 Australian Open in Rod Laver Arena.

b)             Return economy airfares for the winner and one (1) guest between the winner’s closest Australian state or territory capital city and Melbourne, Victoria, to attend the applicable 2026 Australian Open matches.

c)             Three (3) nights’ accommodation at a minimum 4-star hotel in Melbourne, Victoria with twin/double share over the applicable 2026 Australian Open match period. 

d)             Return private car transfer between Melbourne Airport and the winner’s accommodation in Melbourne, Victoria.

5.6         The following conditions apply to the Prize:

a)             The winner and their guest must be available to travel between Monday, 12 January 2026 and Sunday, 1 February 2026.

b)             Final travel and ticket dates will be determined by the Promoter, in its absolute discretion, based on the tickets that are available to the Promoter for the purposes of the Competition.

c)             The return economy flights must depart from and return to the major domestic airport that is closest to where the winner resides (in either Adelaide, Brisbane, Canberra, Darwin, Hobart, Perth or Sydney). If a winner of a Prize resides in Victoria, flights and transfers will not form part of the Prize and the flights and transfers will not be redeemable for cash. 

d)             The winner and their guest must travel together, including by departing from and returning to the same city, travelling together on the same flights, and staying together in the same accommodation.

e)             The winner must be 18 years of age or above. If a winner’s guest is under 18 years of age, the guest must obtain the consent of, and be accompanied by, their parent or guardian to participate in the Prize.

f)               The winner and their guest are responsible for organising and covering the cost of transport to and from the airport of initial departure and final return.

g)              Prize suppliers (including airlines and accommodation providers) will be chosen by the Promoter, in its absolute discretion, based on the airlines and accommodation that are available to it for the purposes of the Competition. Further information regarding how winners must accept the Prize is set out at clause 8.1 below. 

h)             The Prize is subject to, and conditional on, the winner and their guest accepting the standard terms and conditions of the individual Prize suppliers and service providers.

5.7         The maximum total value for all Prizes in the Prize pool is AUD $19,500 (including GST). Prize values are correct as of 14 October 2025. The Promoter accepts no responsibility for any change in Prize value between 14 October 2025 and the ultimate date on which the Prize is awarded, taken or received. Winners are not entitled to receive any money from any party if there is a difference between the maximum Prize value and the actual Prize value at the ultimate date on which the Prize is awarded, taken or received.

5.8         Prizes are not redeemable for cash and are not transferrable or exchangeable, unless otherwise advised. Frequent flyer points do not form part of the Prize.

5.9         The Prize is a single event holiday and cannot be separated into different holiday segments.

5.10     Unless expenses are expressly stated in these Terms and Conditions to be expenses which are part of the Prize, all other expenses incurred by a winner and (if applicable) their guest in accepting the Prize are the responsibility of the winner and (if applicable) their guest. This includes but is not limited to travel to and from the airport of initial departure and final return, all meals, spending money, incidentals, mini-bar, laundry, room service, telephone calls and all other ancillary costs. A credit card imprint may be required from Prize winners at check-in to their hotel for all incidental charges and security.

5.11     Alterations to the Prize itinerary once confirmed are not guaranteed. However, if changes can be accommodated, any costs associated with alterations made by the winner and/or their guest, including changes to confirmed flights and/or accommodation details, will be at the expense of the winner.  

5.12     The Promoter is not liable for any cost incurred if the Prize winner and/or their guest fail(s) to attend their trip or part of their trip. For clarity, no compensation or alternative travel plans will be arranged if the Prize winner and/or their guest miss their outbound or return flights or fail to meet any check-in requirements. These costs will be the sole responsibility of the Prize winner and/or their guest.

5.13     To the extent permitted by law, if a Prize (or any part of a Prize) becomes unavailable, the Promoter will substitute the Prize (or part of the Prize) with a prize of equal or greater value, at the Promoter’s sole discretion, subject to any written directions from a regulatory authority.

5.14     It is the responsibility of the winner and their guest to ensure that they have full and correct documentation for travel and other required documentation, at their own cost.

5.15     The 2026 Australian Open in Rod Laver Arena tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and/or all individual Prize suppliers expressly reserve the right to eject any winner (and/or their guest) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Prize.

 

6. Prize Draw   

6.1         The Prize draw will be held on Monday, 1 December 2025 at 15:00 AEDT (Prize Draw) at Anisimoff Legal, Level 3, 162 Collins Street, Melbourne VIC 3000, in the presence of an independent scrutineer.

6.2         The first three (3) valid entries drawn at random from all entries will each win a Prize. Up to three (3) reserve winners will be drawn and recorded in case an invalid entry or ineligible entrant is drawn.

6.3         Eligible Entrants are only eligible to win one (1) Prize. If there are fewer Eligible Entrants than the total number of Prizes, then the surplus Prizes will be forfeited and no bonus prizes will be awarded.

6.4         If the Promoter discovers that a winner has breached these Terms and Conditions or was otherwise ineligible to enter the Competition, the Promoter may disqualify the winner (including before or after winners are announced) and award the Prize to a reserve winner (if available) or hold an Unclaimed Prize Draw in accordance with clause 9 below.

 

7. Winner Notification

7.1         The Prize winners will be notified by phone and email within twenty-four (24) hours of the Prize Draw.

7.2         Each winner's details (first initial, surname and postcode) will be published at kiatennis.com.au on or before Tuesday, 2 December 2025.

 

8. Prize acceptance and delivery

8.1         To accept a Prize, winners must confirm their acceptance of the Prize in writing to the Promoter. The Promoter will then arrange for the winner to deal directly with AB Epicurean Adventures Pty Ltd (ABN 14 604 169 940) (or their agents) to promptly book all travel arrangements and deliver all tickets. Winners must finalise their travel arrangements by Thursday, 18 December 2025 (Prize Acceptance Date) to confirm their acceptance of the Prize.

8.2         If, for any reason beyond the reasonable control of the Promoter, a Prize winner fails to accept the Prize by the Prize Acceptance Date in accordance with clause 8.1 above, the Prize will be deemed to be unclaimed. In such circumstances, the Promoter will conduct an Unclaimed Prize Draw in accordance with clause 9 below, to ensure that all Prizes can be delivered in time for the event.  

8.3         If after the Prize Draw and/or Unclaimed Prize Draw, a winner does not take/redeem a Prize (or an element of a Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.

 

9. Unclaimed Prize Draw 

9.1         A draw for any Prizes that remain unclaimed will take place at Anisimoff Legal, Level 3, 162 Collins Street, Melbourne VIC 3000 on Friday, 19 December 2025 at 11:00 AEDT.

9.2         Any winners of unclaimed Prizes will be notified by phone and email within twenty-four (24) hours of the Unclaimed Prize Draw.

9.3         Any winners of unclaimed Prizes will have their first initial, surname and postcode published on kiatennis.com.au on or before Monday, 22 December 2025.

9.4         Winners of any unclaimed Prizes must accept their Prize and finalise their travel arrangements by Monday, 5 January 2026 in a manner consistent with clause 8 above.

 

10. Promotion

10.1     If an Eligible Entrant wins and accepts a Prize, Eligible Entrants:

a)             agree to participate in all reasonable media editorial requests of the Promoter, including but not limited to, being interviewed and photographed, without remuneration or compensation; and

b)             grant the Promoter a perpetual, non-exclusive, royalty free and fee free licence to use their name, likeness image and/or voice, and any footage and photographs obtained in accordance with clause 10.1a) above, in all media worldwide for the purposes of promoting the Competition and the Promoter (including its products).

 

11. Privacy

11.1     The Promoter and its related entities will collect an entrant’s personal information including the entrant’s full name, email, phone number and address for the purposes of conducting and promoting the Competition (including for the purposes of identifying and notifying winners and delivering Prizes).

11.2     The Promoter will handle the entrant’s personal information in accordance with the Promoter’s Privacy Policy, which is available on its website at https://www.kia.com/au/util/privacy.html. By entering the Competition, entrants accept the Promoter’s Privacy Policy. 

 

12. Liability

12.1     Consumers have rights under the Australian Consumer Law and similar legislation, which cannot be excluded, restricted or modified by the Promoter, including statutory consumer guarantees and other consumer rights provided under the Competition and Consumer Act 2010 (Cth). These Terms and Conditions do not exclude, modify or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for personal injury (including without limitation negligence) or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Competition.

12.2     Subject to this clause 12 and to the extent permitted by law, the Promoter and its associated agencies and companies assume no responsibility for:

a)             any entry that is incorrect, late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter (including without limitation technical difficulties or an equipment malfunction);

b)             any Prizes that are late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter (including without limitation winners providing incorrect details);

c)             any theft, unauthorised access or third-party interference in the Competition;

d)             any variation in Prize value; 

e)             any tax liability incurred by a winner or entrant;

f)               any loss, damage or injury suffered by a winner or their guest arising out of, or in connection with, the Prize, their use of the Prize, attendance at the Prize event, or the conduct of third-party Prize suppliers; and/or

g)              if the appearance of any or all athletes, or the 2026 Australian Open event, is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter.

12.3     If for any reason beyond the reasonable control of the Promoter (including without limitation in the event of war, terrorism, state of emergency, pandemic or any other kind of disaster or event beyond the reasonable control of the Promoter), the Promoter is unable to run the Competition as planned, the Promoter reserves the right to take any action that may be available to it and to terminate, modify or suspend the Competition, subject to any written directions from a regulatory authority.

 

13. General

13.1     The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any individual who has breached these terms and conditions, tampered with the entry process or engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter's legal rights to recover damages or other compensation from an offender are reserved.

13.2     Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

13.3     If there is a dispute about the conduct of the Competition, entrants must contact the Promoter to attempt to resolve the dispute in good faith. If the dispute cannot be resolved, either party may refer the matter to mediation.
