PERSONAL DATA PROTECTION NOTICE FOR PT KIA SALES INDONESIA

1. INTRODUCTION

At Kia, people's privacy is of prime importance. We, PT Kia Sales Indonesia (hereinafter referred to as “we”, “us”, “our” or “Kia Sales Indonesia”), wish to assure you that we take your privacy seriously and are committed to the protection of our customers’ and business partners’ personal data.

In line with our compliance with the Law of the Republic of Indonesia No. 27 of 2022 on Personal Data Protection (“PDP Law”), this Kia’s PDP Notice serves to inform you that your personal data is being processed by us or on our behalf and you hereby give your consent to us for collection and processing of your personal data (as described in the paragraph below). For the purpose of this Kia’s PDP Notice, the terms “personal data” and “processing” shall have the same meaning as prescribed in the PDP Law.

2. DEFINITION OF PERSONAL DATA

Personal data may include, but not limited to, your name, salutation, contact details, biometric data, mailing address, e-mail address, occupation, Resident Identity Number (KTP), passport number, income, credit or debit card information, bank account, images (photographs and video recordings/CCTV), lifestyle data, and any other such information that may be relevant to your application or request in your dealings with us.

3. COLLECTION OF PERSONAL DATA

A. Customer or Potential Customer

Your personal data is being collected or is to be collected from our website, social media, application, authorized dealers and third parties through the following events or circumstances (through oral or written communications), includes, but not limited to :

1.When you contact us through Kia’s authorised dealers (including test drive, vehicle booking and/or purchase and/or inquiries regarding Kia’s products and/or services);

2.When you contact us through Kia Indonesia Website or Kia Sales Indonesia official social media platform;

3.When you contact our Customer Service;

4.Through your participation in marketing activities or events conducted by us or Kia’s authorised dealers, including but not limited to road shows, exhibitions and / or business card collections;

5.Through third parties such as our business partners and / or your agents which you have consented to such disclosure;

6.Through your participation in customer satisfaction surveys and/or respond to communications;

7.During servicing of your vehicle at Kia’s authorised dealers;

8.Data provided by you such as comments, queries or messages submitted to us in whatever manner; and/or

9.Through cookies from the use of Kia Sales Indonesia’s website.

B. Dealer, Contractor, Vendor, Supplier or Service Provider

Your personal data is being collected or is to be collected from you or from your third parties, your employer or searches carried out or information obtained from any regulatory or credit reporting agency, includes, but not limited to:

1.When you contact us directly in relation to any commercial transactions;

2.When tendering for projects;

3.When you are entering into any contracts or agreements with us;

4.When you send us completed enquiry and / or credit application forms;

5.When we are assessing your creditability;

6.Through third parties such as our business partners; and/or

7.Through cookies from the use of Kia Sales Indonesia’s website.

4. PROCESSING AND RETENTION OF PERSONAL DATA

A. Customer or Potential Customer

Your personal data is being or is to be collected and further processed for the purposes, including the following (“Purposes”):To evaluate and/or process any application submitted by you;

1.Assessing and/or processing any application submitted by you;

2.Processing your order to purchase vehicle and receive other products and / or services from us;

3.Verifying your identity when you contact us;

4.Responding to enquiries, comments and suggestion from you;

5.Membership programme or loyalty programme for Kia customers and members;

6.Enabling us to provide your requested product and service to you and the relevant information;

7.Managing our relationship with you and provide you with better customer services;

8.Assisting Kia Sales Indonesia to detect and prevent fraud and/or illegal activities;

9.Complying with Kia Sales Indonesia’s legal and regulatory obligations in the conduct of its business;

10.Kia Sales Indonesia’s and its affiliates’ internal records management and activities;

11.Market survey, analysis, research and customer profiling for us to study market trends;

12.Providing you with customer support and after-sales services;

13.Facilitating your participation in any contest, event and/or membership program;

14.Improving the quality of Kia’s products and /or services;

15.Supporting the business, financial and risk monitoring, planning and decision making;

16.Report to any relevant authorities;

17.Responding to your request for a test drive session; and

18.Such other purposes directly related to the foregoing purposes.

Optional Purposes (Marketing):

In addition to the aforesaid Purposes, your personal data may be collected, processed and used for the following optional purposes:

1.Dealing with the mailing and communication of information literature (e.g. invitations to exclusive events, information on promotions and offers, sending magazines and /or newsletters); and

2.Identifying other products and services which might be of interest to you and to inform you about Kia’s products and services.

You may opt-out from receiving such marketing or promotional material at any time. You may select the “unsubscribe” option provided in Kia Sales Indonesia’s email blasts / short message services (“SMS”) blasts or you may contact Kia Sales Indonesia’s customer support at the details provided below.

B. Dealer, Contractor, Vendor, Supplier or Service Provider

Your personal data is collected and further processed as required or permitted by law and to give effect to the requested commercial transaction, including the following:

1.To administer and give effect to the commercial transaction (such as dealership agreement, tender award, contract for service and / or consignment agreement);

2.To provide you with dealer support (for dealers);

3.To process your credit account application;

4.To assess your credit worthiness;

5.To process any payment related to the commercial transaction;

6.For internal investigations, audit or security purposes;

7.To comply with Kia Sales Indonesia’s legal and regulatory obligations in the conduct of its business;

8.To support the business, financial and risk monitoring, planning and decision making of Kia Sales Indonesia or Kia Group of companies;

9.To support the business, financial and risk monitoring, planning and decision making of Kia Sales Indonesia or Kia Group of companies;

10.For our internal records management.

5. RETENTION PERIOD AND DATA NECESSITY

We may keep your personal data for a reasonable period to enable us to fulfil the Purposes. If your personal data is no longer required for the Purposes, we will take all reasonable steps to ensure that your personal data is destroyed or permanently deleted based on the retention principle under PDP Law.
Your personal data as requested by us is necessary for us to perform any of the Purposes. If you fail to supply us the personal data as requested, we may be unable to process your personal data for any of the Purposes.

6. DISCLOSURE OF PERSONAL DATA

Your personal data, which we gathered from various sources mentioned above, may be disclosed by us to the following classes of third parties (in or outside of Indonesia) as required under PDP Law, the relevant laws or pursuant to relevant contractual relationship (for example, where we appoint third party service providers) or for the purposes or directly related to the purposes stated above:

a.Any associated companies and entities within Kia Sales Indonesia or Kia Group of companies;

b.Kia Sales Indonesia’s and Kia Sales Indonesia’s authorized dealers’ parts suppliers;

c.Our business partners such as insurance companies, banks and financial institutions;

d.Government authorities, departments, commissioners or agencies, statutory authorities and industry regulators;

e.Law enforcement bodies and agencies;

f.Third parties appointed by us to provide services to us or on our behalf (such as auditor, lawyer, consultants, professional advisors, company secretary, service providers, vendors, telecommunications companies, contractors, advertising agency, events and training organisers, agents and other advisors);

g.Outsourcing partners;

h.Data center and servers for data storage purposes; and/or

i.Organisations who provide archival, auditing, debt collection, marketing, delivery, recruitment, call center, technology, research, utility, and security services to us.

7. RIGHT TO ACCESS AND CORRECT PERSONAL DATA

Subject to the exceptions and restrictions provided under Indonesian law (PDP Law), you may have the right to ask for a copy of your personal information and data, or request for access to, correction, update or limit the processing of your personal data or withdraw your consent previously given to us (in full or in part) to the processing of your personal data at any time hereafter.

8. TRANSFER OF PERSONAL DATA

We may transfer your personal data to entities within Kia Sales Indonesia or Kia Group of companies who are located outside Indonesia, and you hereby give your consent to the transfer, with the understanding that we will ensure an equivalent level of protection as required by the Indonesian PDP Law.

9. GENERAL

Kia Sales Indonesia may modify or update this Kia’s PDP notice to reflect any changes to its privacy practices, without prior notice and any such amendment will be notified via our official website. You are advised to visit the said official websites from time to time.
We assure you that we are practicing prudent actions and taking necessary measures when dealing with your personal data for the activities mentioned above.
We trust that you consent and agree to the terms above with respect to our processing of your personal data and information. In the event of any inconsistency or conflict between the English version and the Bahasa Indonesia version of this Notice, the Bahasa Indonesia version shall prevail.
